1. Acceptance & Modification of Terms

By accessing or using the Tutors Parliament platform (website, mobile application, and related services), you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, you must not use our platform.

We reserve the right to modify these Terms at any time. We will notify Users of material changes at least 15 days before they take effect via email and/or platform notification. Continued use after the effective date constitutes acceptance of the updated Terms.

2. Nature of Service (Marketplace Facilitator)

Tutors Parliament operates strictly as an online marketplace and aggregator. We facilitate connections between students/parents ("Clients") and independent educators ("Tutors"). Tutors Parliament is not an educational institution, school, or direct employer of the Tutors. We do not provide the tutoring services directly, nor do we control the specific teaching methods utilized by Tutors.

3. Independent Contractor Status

All Tutors registered on Tutors Parliament operate as Independent Contractors. There is no employer-employee, partnership, or joint venture relationship between Tutors Parliament and the Tutors. Tutors are solely responsible for their own taxes, insurance, and teaching materials.

4. Verification & Background Checks

While Tutors Parliament implements a strict onboarding process—including identity and document verification—we cannot absolutely guarantee the accuracy of all information provided by Tutors. Clients are advised to exercise their own discretion and judgment. For home tuition (in-person), it is the Client's responsibility to ensure a safe environment.

5. User Eligibility & Child Safeguarding

  • Age Requirement: You must be at least 18 years of age to register an account.
  • Parental Consent (DPDP Compliance): If the User is under the age of 18, they must be accompanied by a parent or legal guardian who provides explicit, verifiable consent for the child's data to be collected and processed. By using this platform on behalf of a minor, the parent/guardian acknowledges responsibility for all activities undertaken through the account and agrees to supervise all interactions with tutors. Tutors Parliament reserves the right to request documentation to verify parental consent.
  • Accuracy of Information: You agree to provide accurate, current, and complete information during registration and booking.
  • Code of Conduct: Users must maintain professional behavior. Any form of harassment, abuse, or inappropriate conduct will result in immediate termination.

6. Non-Circumvention Policy

Clients and Tutors agree not to circumvent the Tutors Parliament platform for payments or future bookings. Once a connection is made through our platform, all subsequent scheduling and payments must be processed through or registered with Tutors Parliament. Violation of this clause will result in immediate account termination and a penalty fee.

7. Fees, Payments & Refunds

Fees are determined based on subject, grade level, and tutor experience. Tutors Parliament charges a facilitation fee included in the total cost. Payments must be made as per the schedule provided during booking.

Refunds: Refund requests are evaluated on a case-by-case basis. If a Client is unsatisfied with a Tutor after the initial sessions, Tutors Parliament will offer a free replacement. Refunds for unused pre-paid classes will be processed after deducting a cancellation fee and the cost of completed classes.

8. Communication Consent

By registering, you provide explicit consent to receive service-related communications via phone calls, SMS, WhatsApp, and email from Tutors Parliament. You may opt out of promotional communications at any time by contacting our support team or clicking 'unsubscribe' in emails. SMS messages are sent in compliance with TRAI DLT regulations.

9. Suspension & Account Termination

Tutors Parliament reserves the right to suspend or terminate any User account, with or without notice, for violations of these Terms, suspected fraudulent activity, harmful conduct, or at our sole discretion. Upon termination, all active bookings will be cancelled, and any prepaid amounts will be refunded in accordance with our Refund Policy.

10. Force Majeure

Neither Tutors Parliament nor Users shall be liable for delays or failures in performance resulting from acts beyond reasonable control, including but not limited to natural disasters, pandemics, government actions, internet or telecommunications failures, strikes, or other force majeure events. During such events, obligations shall be suspended for the duration of the event.

11. No Guarantee of Academic Outcomes

While we strive to provide highly qualified educators, Tutors Parliament does not guarantee any specific academic results, test scores, or admissions. Educational progress depends heavily on the student's personal effort, attendance, and capability.

12. Limitation of Liability

To the maximum extent permitted by law, Tutors Parliament shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or academic standing, arising from your use of the platform. Our total liability for any claim arising out of these terms shall not exceed the amount you paid to us for the specific service in dispute.

13. Grievance Redressal & Data Breach

Grievance Mechanism: In compliance with the DPDP Act, for any grievances or complaints, you may contact our Grievance Officer at grievance@tutorsparliament.com. We commit to acknowledging your complaint within 48 hours and resolving it within 15 working days.

Breach Notification: In the event of a personal data breach, Tutors Parliament will notify affected users and the relevant authorities within the timeframe mandated by Indian law.

14. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in New Delhi, India.
